CONSTITUTION, RULES AND BY LAWS

dated November 2005

1)         The club shall be called the-

PLYMOUTH AND DISTRICT COARSE ANGLING CLUB

(P.A.D.C.A.C.)

Here after known as the club

OBJECTIVES

2)         To co-operate, with the E.A., Riparian owners and other clubs and associations in matters affecting fishing interests. To stock and assist in re-stocking club waters. To acquire rights, and generally, to promote the sport of all members.

MEMBERSHIP

3)         The club shall consist of:-

Life Members, Senior / Full Members & O. A. P’s.  Hereafter known as FULL MEMBERS and JUNIOR MEMBERS

4)         Membership will be restricted to a fixed number decided by the committee, but this can be changed at any time by the committee to suit ruling conditions.

All Members shall purchase an Annual Membership

The Annual Membership Fee (AMF) will be decide and set at the AGM.

The AMF will be due on the first day of January in each year, and a reduction on the AMF for members takes place until 31st January, after this date the full amount is due.

The AMF for OAP member’s will be half that of a Full Membership on January 1st

The AMF for junior members will be one third of the Full Membership on January 1st

Life Members and Serving committee members will not pay an AMF this will be deemed paid from club funds

A junior member shall be a person who has not attained the age of 16 as of the 1st of January in that year.

Children under 12 years of age have free membership but must be accompanied at all times by a Full member who has attained the age of 18 years and is also a parent / guardian of said child.

From time to time the club may issue concessionary membership books to businesses / establishments / individuals. A Concessionary Membership book is to allow the recipients to fish the club waters only. It is not a Full Membership and does not entitle the recipient to any claim on the club or voting rights

DISSOLUTION

            If at any General meeting of the club, a resolution be passed calling for the dissolution of the club, the Secretary shall immediately convene a Special General Meeting of the club to be held not less than one month thereafter to discuss and vote on the resolution.

            If at that Special General Meeting, the resolution is carried by at least three fourths of the votes cast of the Full Members present at the meeting, the committee shall thereupon, or at such date as shall have been specified in the resolution, proceed to realise the assets of the club and disgorge all debts and liabilities of the club.

            After discharging all debts and liabilities of the club, the remaining assets shall not be paid or distributed amongst the full Members of the Club, but shall be given or transferred to some other voluntary organisation having objects similar to those of the club.

Note- It is the personal responsibility of all members to ensure they comply with all E.A licence requirements, National and Local By-laws, which form part of the rules of the club.

6)         There will be a discount of 50% for any full paying member who is limited to the swims that they fish, due to there requirement to use a wheel chair for mobility.

7          Guest Tickets are available from outlets selling club memberships the cost will be decided at the AGM for 12 and 24 hours. A Full Member of the club must purchase Guest Tickets and accompany there Guest and no discounts are available

8)         Life membership shall be granted to club members who have rendered outstanding service to the club. Life members shall have all the rights and privileges of Full members.

9)         No person shall be deemed a member of the club, or entitled to vote at any meeting until their AMF for the current year has been paid, or be elected to any office, or become a member of the committee or exercise any of the privileges accorded to members. Members may be required to show their membership ticket before admission to the AGM or any general or special meeting.

OFFICERS AND MANAGEMENT

10)       The management of the club shall be in the hands of the committee Consisting of:-

Chairman, Vice Chairman, Secretary, Treasurer, Match Secretary, Specimen Officer, Fish & Environmental Officer, and up to Ten other members. (Hereafter called the officers)  The committee shall have the power to co-opt ordinary members to assist the committee if by attending a committee meeting the said member’s knowledge is to the advantage of the club. Save the co-opted members have no power to vote.

11)       The officers and members of the committee shall be elected at the AGM and hold office until the next AGM

MEETINGS

12)       The AGM will be held on the first Monday of NOVEMBER of each year at venue and time decided by the committee.

13)       All nominations or resolutions for the AGM must be submitted to the secretary in writing and duly proposed and seconded prior to the previous committee standing down at the AGM

14)       The committee meetings will be held on date and venues to be decided at the previous committee meeting

15)       General meetings will be held on the first Monday of each Month at a venue and time decided by the committee.

16)       A special meeting may be held at any time if called by not less than ten members on giving fourteen days clear notice thereof in writing to the secretary. Stating the purpose for which such meeting is called. No business shall be discussed at any special meetings other than of which notice shall be given.

The committee shall have the power to summon a special meeting at anytime on giving seven days notice.

17)       The chairman or vice chairman shall preside at all meetings of the club but should they be indisposed a chairman may be elected by the management committee from those present at the time. The chairman shall not have a vote except, in the event of equality of votes at any committee meeting the chairman shall have the casting vote.

18)       A quorum of 5 members shall be required for any committee meeting. Minutes shall be taken of all proceedings of all the committee and shall be open to inspection by any member of the club applying to the secretary there of

19)       The committee shall have the power to replace any committee member that fails to attend 3 successive committee meetings with out due cause.

20)       All agreements on behalf of the club approved by the committee shall be entered into by two of the following members, Chairman, Treasurer or Secretary.

ACCOUNTS

22)       The accounts shall be made up by 30th of September in every year and be audited by any two members of the club prior to the AGM

23)       The treasurer shall furnish an annual account to every AGM

24)       The treasurer shall keep a true account of all monies expended and received by them and furnish a report to every committee member

25)       The moneys of the club shall be banked in the name of the club

26)       All cheques shall be signed by two of the following officers Chairman, Vice Chairman, Treasurer, Secretary, or Match Secretary

27)       No officer shall authorise expenditure in excess of £50.00p without committee approval

28)       The clubs books of accounts pass books, and all other documents relating to the clubs finances shall be open to inspection by any member of the club applying to the treasurer

DISPUTES AND DISCIPLINARY MATTERS

29)       All disputes arising between members as to matters connected with the club shall be referred to and settled by the committee whose decision is final.

30)       If the conduct of any member in the opinion of the Committee be injurious to interest and character of the club, the committee after a fair hearing shall be empowered to expel or suspend them from the club.

31)       Any Member who shall cease to be a member of the club for what ever cause shall have no claim upon the property of the club. Nor have any part of the subscription returned.

32)       Members of the club shall be deemed to constitute acceptance of the clubs constitution, rules and by laws as in force and operation

ALTERATION TO CONSTITUTION RULES AND BY-LAWS

33)       The clubs constitution shall not be altered and no new rules shall be made, nor any of the rules herein contained or hereafter to be made shall be amended, altered or rescinded without three fourths of the votes cast by those full members present at the AGM or special general meeting convened for that purpose. For avoidance of doubt an abstention shall not be treated as a cast vote.

34)       The committee shall have the power to amend alter or add to the clubs By-laws such by laws to be in force immediately on approval by the committee

35)       Any member shall be entitled to approach the committee to alter amend or add to any club by laws

CLUB BY-LAWS

Note- It is the personal responsibility of all members to ensure they comply with all E.A licence requirements, National and Local By-laws which form part of the rules of the club.

36)              All fish in the clubs waters are the property of the club and including eels must return them to the water alive.

37)              All anglers must on request produce their club membership to any club official or club member and allow their catches of fish or tackle they have in use at the time to be inspected by such a person.

38)              All members must hold a current E.A licence and upon request produce their license to any club official or member

39)              At no time shall more than two rods be used except from the 1st of October to the 14th March. When three rods may be used by one person in any one swim. The onus to be on the angler to ensure the correct cover of rod licence.

40)              No person shall have rods in the water unattended

41)              No person shall remove fish except with rod and line and the assistance of a landing net

42)              The use of gaff is prohibited

43)               Ground bait must not be thrown into the water after fishing ceases

44)              All keep nets must be knotless and shall have a top ring of not less than 12 inches diameter and a minimum length of 6 feet

45)              All carp must be return immediately after capture and only to be placed in wet sacks for weighing in purposes. All sacks used for the retention of fish for such purpose shall be perforated industrial nylon type and have a minimum size of 36 inches by 36 inches

46)              No line or litter shall be discarded and any member or angler proved to have left litter or line at or in their swim will be liable to suspension or expulsion from the club every angler shall be responsible for leaving their swim clear of litter and line when they leave whether its theirs or not

47)              No member shall cut trees or water lilies without permission of a committee member or official

48)              All persons must keep to defined paths to get to and from club waters

49)              All gates must be shut and locked or securely fastened after being opened

50)              No treble hooks shall be used and all hooks over 16 must be barbless

51)              Radios may only be used with an ear piece

52)              No dogs allowed except on a lead

53)              No member under the age of 18 to fish any club waters during the hours of darkness unless accompanied by parent, guardian, or full member who has attained the age of 18 years and has been appointed by the parent/guardian. ALL children under 12 must be accompanied at all times, by a parent/guardian who shall also be a Full Member of the club

54)              All cars must parked only in designated areas as shown on club maps

55)              No camping tents or fires allowed at the edge of club waters or on any adjoining land

56)              All lamps must be shielded against casting light directly onto the water surface

57)              Unhooking mats must be used when using lines over 3 lbs

58)              A swim/peg shall be half way to adjacent swim and halfway across the pond no line should pass beyond these points

59)              Fishing will only be allowed from officially recognised Swims/ pegs

60)              All nets shall be dipped in the tanks provided at each club venue before fishing
